REFER A FRIEND 24/25 £150 CASHBACK TERMS & CONDITIONS

 

1. THE PROMOTER
   a. The Promoter is Greystar Europe Holdings Limited of The Gilbert, 40 Finsbury Square, London, EC2A 1PX (the ‘Promoter’).

2. TERMS
   a. These standard terms and conditions (‘Terms’) constitute the entire agreement between a Referrer and/ Referred Friend and the Promoter with respect to the matters set forth herein, and no oral statements or prior written matter not specifically incorporated herein shall be of any force or effect at the time of entering the Promotion and/or redeeming the Reward.
   b. These Terms apply to the Promotion and by making a Qualifying Referral you are agreeing to be bound by these Terms.

3. PROMOTION PERIOD
   a. The Promotion shall open at 9:00AM on 11th December 2023 (the ‘ Opening Date’) and close at 11:59PM on 3rd May 2024 (the ‘Closing Date’).
   b. To enter the Promotion and to be eligible for a Reward, both the Referrer and the Referred Friend must have completed and/ or met all four (4) requirements at section 4 a below with the Canvas Property Reception Team or by other means as determined at the sole discretion of the Promoter by the Closing Date.
   (‘Qualifying Referral’ and ‘ Qualifying Referrals’ shall have the same meaning).
   c. All Entries (i) received after the Closing Date, and/ or (ii) that do not meet all Eligibility Requirements are automatically disqualified.
   d. For the avoidance of doubt the Reward is not redeemable in respect of any other property owned or managed by the Promoter.
   e. The Promoter will not accept:
   i. responsibility for Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
   ii. proof of transmission as proof of receipt of Qualifying Referral to the Promotion.

4. ELIGIBILITY
   a. To qualify for the Rewards, the Referrer and the Recommended Friend must both choose the same incentive and meet the following criteria (“Qualifying Referral”): -
   i. “Referrer”: A Referrer is a Canvas resident who
   a. has entered into an Assured Shorthold Tenancy agreement with the Promoter for the 2023/24 or 2024/25 academic year at one of the below listed Canvas Properties; and
   b. is in full time education; and
   c. has referred a Referred Friend by passing the referral incentive code to them, for inputting when making the booking
   ii. “Referred Friend”
   a. The Referred Friend must
   i. enter into an Assured Shorthold Tenancy Agreement with the Promoter for one of the below listed Canvas Properties for the 2024/25 academic year for a minimum of a 44 week term using the unique code provided and providing the details of their Referrer
   ii. complete all associated paperwork and pass any checks required by the Promoter and
   iii. pay their first instalment of Rent.
   iv. Moved into the Canvas Property.
   b. Any terms not defined in these Terms shall have the same meaning as defined in the Tenancy Letter and Tenancy Agreement.
   c. In entering the Promotion, you confirm that you are eligible to do so and eligible to claim a Reward.
   d. By making a Qualifying Referral, you are agreeing to be bound by these Terms.
   e. The Promoter may require you to provide proof that you are eligible for the Reward, and by applying for the Reward, you confirm that you are eligible to do so.
   f. There is a limit of one (1) Reward for each Qualifying Referral made by the Referrer. The Referrer can use these Incentives in conjunction with other offers. Referrals on behalf of another person and/ or Referrer will not be accepted. For the avoidance of doubt, the Incentive will only be given to the person named on the Tenancy Agreement.
   g. The Resident can claim this Reward in conjunction with the Canvas Properties Rebooker offer for 2024/25. However, the Resident cannot claim this Reward in conjunction with any other offers that may be available during this time.
   h. If the Referred Friend is in a dual occupancy room only one (1) Reward will be given for both residents.
   i. The Referred Friend must quote promo code REFER150 at time of booking and provide details of their Referrer otherwise they will not be eligible for a Reward.
   j. For the avoidance of doubt, Holding Fees are not refundable, even where the Referrer and/ Referred Friend has not collected their Reward. Any refund of the Holding Fee is at the sole discretion of the Promoter.

5. THE PROMOTION
   a. Both the Referrer and/ Referred Friend who submit a Qualifying Referral before the Closing Date will be eligible for a £150 cashback.
   b. The Reward should be claimed after the 2024/25 move in date and will be given as a refund into the Resident’s bank account by the participating Canvas Property reception team by 31 December 2024.
   c. Referrer and/ Referred Friend who are eligible are responsible for all other costs and arrangements associated with their Tenancy Agreement, including any necessary travel documents, passports and visas.

6. PARTICIPATING CANVAS PROPERTIES
   a. Canvas Coventry Arundel House property located at Arundel House, Whitefriars Lane, Coventry, CV1 2NA (‘Canvas Coventry Arundel House’)
   b. Canvas Coventry City Point property located at 2 Gas Street, Coventry, CV1 4FY (‘Canvas Coventry City Point’)
   c. Canvas The Heights, 30 Staniforth St, Birmingham, B4 7DR (‘Canvas The Heights’)
   d. Canvas The Old Fire Station, Aston St, Birmingham, B4 7DA (‘Canvas The Old Fire Station’)
   e. Canvas Glasgow property located at Boyce House, 47 Kyle St, Glasgow, G4 0JQ (‘Canvas Glasgow’)
   f. Canvas Manchester property located at River Street Tower, 2 River Street, Manchester, M15 5GQ ('Canvas Manchester')
   Referred to as the ‘Canvas Property’.

7. ANNOUNCEMENT
   a. The Referrer and/ Referred Friend who have successfully submitted a Qualifying Referral will be contacted by the Promoter within their first semester using the telephone number or email address provided with the online Qualifying Referral. The Promotor will clearly advise how this offer to claim.
   b. Referrer and/ Referred Friends will have 7 days from being notified to claim their Reward. If a Referrer and/ Referred Friend who has been rewarded with a Reward has not claimed their Reward within this period, the Referrer and/ Referred Friend loses the right to claim the Reward.

8. LIMITATION OF LIABILITY
   a. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate any Referrer and/ Referred Friend and/ or entrant or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Promotion and/ Reward except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
   b. The Promoter accepts no responsibility for any disappointment of any kind suffered by any entrant in entering the Promotion, including as a result of any entrant being rewarded or not rewarded with a Reward.

9. DATA PROTECTION AND PUBLICITY
   a. You agree that the Promoter may use your name, image and town or county of residence to announce the same and for any other reasonable and related promotional purposes.
   b. You further agree to participate in any reasonable publicity required by the Promoter.
   c. By entering the Promotion, you agree that any personal information provided by you with the Qualifying Referral may be held and used only by the Promoter or its agents and suppliers to administer the Promotion.

10. GENERAL
    a. The Promoter reserves the right in its absolute discretion to disqualify any Qualifying Referral and/ or Referrer and/ Referred Friend if it has reasonable grounds to believe that an entrant has breached any of these Terms or any applicable law. Each Referrer and/ Referred Friend acknowledges and agrees that any failure to comply with these Terms could lead to the Promoter disqualifying that person, without the Promoter giving any reason for such disqualification or granting any opportunity for challenge.
    b. The Promoter reserve the right to cancel or amend all or any part of the Promotion and/or Terms without notice and at its sole discretion where it becomes necessary to do so, including for any event that is outside of the Promoter's reasonable control. Any changes to these Terms, or cancellation of the Promotion, will be posted on the Promoter’s website (www.Canvas-living.com). It is the responsibility of entrants to keep themselves informed as to any changes to these Terms.
    c. This Promotion is subject to limited availability and will be available on a first come first served basis. This promotion is limited to 2 referrals per Referrer. The Rewards are not transferable to another individual and no cash or other alternatives will be offered.
    d. These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including the Promotion), existence, negotiation, validity, termination or enforceability (including non-contractual disputes or claims) shall be governed by the laws of England and Wales.
    e. The Courts of England shall have exclusive jurisdiction in relation to any dispute or claim arising out of or in connection with these Terms or their subject matter, existence, negotiation, validity, termination or enforceability (including non-contractual disputes or claims).
